Background
It is estimated that around half of the world's quantities of obsolete pesticides can be found in the area of the former Soviet Union and a large portion of those in Central Asia. The region was an important centre for agriculture and particularly cotton production during Soviet times, with mandatory pesticide application and over-supply. Together with weaknesses in the capacity of responsible institutions and actors to effectively manage pesticides and associated wastes throughout their lifecycle and with gaps in the legal and regulatory frameworks in the region, substantial amounts of obsolete pesticides have been accumulated and widespread contamination of sites occurred.
FAO is implementing a Project as part of an EU Action aiming at a transition to a sustainable, socially just, resilient and climate neutral economy in Uzbekistan. The Project will contribute, under the overall EU Action, to supporting the country to both mitigate and adapt to the effects of climate change and to reduce environmental degradation. This is achieved through increasing national capacities, strengthening institutions, improving regulations, tools and coordination mechanisms, while addressing key elements towards improved chemical waste management in Uzbekistan and moreover implementing greener agricultural practices for reducing the use of pesticides.
Among other, legislation and regulation related to pesticide life-cycle management, chemicals and waste management, and relevant post-registration regulatory mechanisms will be reviewed and further developed based on the results and conclusions from recent assessments and ongoing consultations with relevant national stakeholders.
Tasks and responsibilities
Under the overall supervision of the FAO Sub regional Coordinator for Central Asia and Assistant FAO Representative in Uzbekistan, the technical supervision of the Legal Officer, Development Law Service, the FAO Budget Holder, in coordination with the Lead Technical Officer (LTO) and day to day supervision of the Senior Technical Adviser and in close collaboration with the National coordinator and international legal consultant (legal IC), the national consultant will undertake the following:
• Under the supervision of the Legal IC, provide targeted legal support related to the Rotterdam Convention ratification process, including participation in consultations with relevant national counterparts, review and consolidation of comments, and legal input to the preparation of documentation required for inter-agency clearance and further submission to the competent national authorities. (10 working days)
• Review legal and regulatory issues related to pesticide post-registration control, pesticide life-cycle management, inspection-related measures, pesticide container management and selected aspects of pesticide residue monitoring, and provide legal comments on relevant draft materials prepared by relevant national counterparts. (16 working days)
• Under the supervision of the Legal IC, review selected legal and regulatory issues related to hazardous waste handling and transportation, Extended Producer Responsibility (EPR), Container Management System (CMS) related measures, and Highly Hazardous Pesticides (HHPs), and provide legal comments on relevant draft legal and regulatory materials prepared within the assignment. (12 working days)
• Review comments received from relevant counterparts and provide legal comments on draft legal and regulatory documents prepared within the assignment, taking into account relevant international agreements and approaches where appropriate. (14 working days)
• Provide legal comments on draft materials related to development of the Hazardous Waste Strategy within the agreed scope of assignment, including selected aspects related to waste management hierarchy and hazardous waste transportation. (4 working days)
• Prepare a consolidated end-of-assignment report summarising activities undertaken and legal support provided under the assignment. (4 working days)

5. Excellent oral and written communication skills in Uzbek (Russian) and English.
