Individual Consultant on Improving the System of Appointment of Guardians or Trustees for Adult Citizens

Duties The Consultant is expected to perform the following tasks:
Prepare a detailed work plan indicating methods of cooperation, work schedule, identification of project risks, control milestones, and allocation of responsibilities.
Conduct an in-depth analysis of the existing legislation and regulatory legal acts affecting the procedures for appointing guardians/trustees for adult legally capable persons who require trusteeship due to their health condition, as well as for legally incapacitated or partially legally capable citizens (Civil Code, norms on guardianship and trusteeship, procedural rules, documents of health, justice, and judicial authorities), as well as the organizational structure of state bodies; identify constraints and requirements for improvement.
Identify stakeholders and collect the needs and requirements of process participants (courts, justice authorities, "Inson" Social Service Centers, healthcare institutions, local state authorities, NGOs, service providers, and others); conduct interviews/seminars; formalize functional and information requirements.
Conduct an inventory of the existing diagnostic and assessment practices: document the processes of application intake, comprehensive case assessment, preparation of a conclusion regarding the suitability of candidates expressing the intention to become a guardian or trustee, submission to the court, enforcement of court decisions, monitoring, and review procedures; analyze duplications and gaps.
Develop assessment criteria for the appointment of guardians/trustees, including legal, functional, and social risk factors, conflict of interest considerations, transparency and ethical requirements (with strict adherence to ethical standards considering the vulnerability of target groups, including informed consent, voluntary participation, confidentiality, and data protection); prepare standard templates (interview protocol, checklists, conclusion matrices).
Develop the structure and substantiation procedure of the conclusion to be submitted to the court, including the list of required documents, requirements for the evidence base, requirements for expert examinations, and the format of the legal conclusion; establish standards for information exchange and confidentiality between relevant authorities.
Prepare separate Standard Operating Procedures (SoP) for multi-sectoral and internal use and a RACI (roles and responsibilities) matrix for the "Inson" Centers, including definition of tasks, timelines (SLAs), internal control and quality assurance mechanisms, as well as complaint and appeal procedures.
Conduct pilot testing and validation: prepare test data sets, implement the pilot in 3 regions, collect user feedback, and revise the methodology and templates based on the results.
For the purpose of training (capacity building) the members of the "Inson" Centers' working group (social worker, psychologist, legal expert consultant) on the methodology for conducting assessment interviews with candidates expressing the intention to become a guardian or trustee, the Consultant shall:
– develop a practical manual containing a step-by-step methodology for conducting assessment interviews, including the structure of questions and evaluation criteria;
– prepare and deliver at least a 36-hour practical training course (lectures, case studies, role plays, supervision elements, etc.);
– integrate into the training modules ethical standards and principles of "do no harm," informed consent, confidentiality, and data protection, taking into account the vulnerability of target groups during interviews and assessments;
– develop assessment interview protocols (templates, checklists) and provide methodological support during the introduction of these instruments into the practice of the "Inson" Centers.
– Pilot the conclusion/recommendation mechanism and interview methodology in at least 3 regions and refine them based on monitoring indicators.
Develop a modular training program of at least 16 hours (2 days) aimed at forming guardianship and trusteeship skills for candidates expressing the intention to become a guardian or trustee, and provide support in its introduction into practice.
Ensure that all analyses and proposals are developed in line with human rights-based and disability-inclusive standards, as well as the core principles of adult guardianship/trusteeship (best interests of the beneficiary, respect for human rights, participation and voice, non-discrimination, safety and "do no harm," confidentiality, and interagency cooperation).
Prepare and submit the final package of documents, including the Standard, assessment criteria, court conclusion templates, SoP and RACI matrix, and training package; provide recommendations on version control, regular updates, performance evaluation, and a sustainability/support plan.
The indicative implementation schedule covers the main types of activities, with multiple tasks to be carried out in parallel. As an individual consultant, the candidate shall submit a detailed schedule aligned with their proposed methodology and approach and shall ensure that all tasks are completed no later than September 2026.

Experience and Skills:
– At least 5 years of practical experience in adult guardianship/adult protection, case management, and interagency coordination;
– Proven experience in developing and introducing regulatory and methodological documents related to the appointment of guardians/trustees (SoP, RACI, SLA, checklists, complaint/appeal procedures);
– Experience in developing and/or applying court conclusion structures, substantiation procedures, assessment criteria, and decision-making methodologies;
– Experience in organizing comprehensive assessments (psychological, cognitive, and social-functional assessments), including work with ethics and confidentiality (consent, privacy);
– Experience in designing and delivering training/ToT programs, supervision sessions, and capacity-building initiatives within social service networks similar to "Inson," including training of trainers programs;
– Experience in interagency cooperation with social sector institutions, courts/justice authorities, healthcare institutions, NGOs, and service providers;
– Knowledge of international approaches and standards (World Bank, OECD, ILO, UNICEF; Council of Europe practice on adult guardianship, etc.);
– Experience working with public institutions in Central Asian countries shall be considered an advantage.

Language Requirements: Proficiency in Russian or Uzbek.
