Duties |
The scope of the services required from Lawyer will include: 1. Development of legal framework: a. Collaborate closely with international experts to develop a robust legal framework for data protection and privacy of personal medical data in Uzbekistan's digital health initiatives. b. Review and update the legal framework as technologies evolve and new legal challenges arise. 2. Regulatory challenge analysis: a. Analyze and address key regulatory challenges in digital health, including data access, ownership, security, confidentiality, informed consent, and patient rights. b. Propose strategies to resolve potential legal conflicts between stakeholders (healthcare providers, patients, government agencies). c. Provide solutions to bridge gaps between current legal frameworks and emerging digital health technologies. 3. Legal foundation for eHealth systems: a. Develop a legal foundation for the registration of all eHealth information systems and databases. b. Create clear guidelines for the legal responsibilities of entities managing eHealth systems. 4. Consent form development: a. Draft and refine consent forms for the processing of personal data, ensuring alignment with legal requirements. b. Regularly review and update consent forms to reflect changes in law and digital health practices. c. Develop clear, user-friendly consent forms to improve patient understanding and participation in data-sharing initiatives. 5. Employment contract amendments: a. Propose amendments to employment contracts for healthcare workers to incorporate provisions related to data confidentiality, accountability, and consequences of breaches. b. Establish standard contract clauses regarding digital health systems usage and compliance. 6. Personal data protection requirements: a. Define specific requirements for personal data protection within national eHealth systems. b. Ensure compliance with both national and international privacy laws, advising on relevant data protection practices. 7. Standardized data protection requirements: a. Establish standardized data protection requirements for information systems used in healthcare institutions. b. Ensure consistency in data protection measures across all digital platforms within healthcare institutions. 8. Legal expertise and guidance: a. Provide legal expertise and guidance to the DHMU on all matters related to data protection, privacy, and regulatory compliance within the digital health landscape. b. Advise on emerging legal risks related to the adoption of new digital health tools or platforms. 9. Monitoring legal developments: a. Monitor legal developments and evolving regulations related to data protection and privacy. b. Anticipate how changes in law may affect digital health strategies and recommend adjustments. c. Provide timely updates to the DHMU on new legal obligations or compliance requirements. 10. Stakeholder collaboration: a. Collaborate with relevant stakeholders, including government agencies, healthcare institutions, and technology providers. b. Facilitate discussions between stakeholders to align legal and regulatory expectations. c. Assist in drafting agreements, memorandums of understanding (MoUs), or contracts with stakeholders in digital health projects. |

The successful offeror shall meet the following minimum qualification criteria. Not meeting these criteria automatically lead to disqualification from the recruitment process: ● Master's degree in relevant field. ● Proficiency in Uzbek and English. ● Minimum of 5 years of experience in relevant field. At least 3 years of experience working in the healthcare sector.
EVALUATION CRITERIA:
General qualification: ● Master's degree in a relevant field such as law (Jurisprudence) or Social Sciences with extensive research experience in e-governance (holding additional professional education or advanced training programs in relevant fields is beneficial). ● Years of experience with demonstrated success in meeting legal requirements for e-government in the social sector. ● Years of experience in developing guidelines and regulations concerning data protection and confidential medical data.
Other experience: ● Previous experience working with eHealth information systems and their implementation is preferred. ● Demonstrated understanding of emerging technologies and their potential applications in healthcare.
Other skills: ● Proficiency in handling, analysing guidelines and regulations, and writing comprehensive reports. ● Proven ability to work under pressure and demonstrate effective leadership qualities. ● Strong analytical and problem-solving skills to address complex legal challenges within the digital health landscape. ● Excellent communication and interpersonal skills to collaborate effectively with diverse stakeholders and provide clear legal guidance. |
